The purpose of these Terms and Conditions is to define the terms and conditions for the provision of the Services on the website www.joubert.fr, hereinafter referred to as “the Service” and the Terms and Conditions of Use of the Service by the User.

Definitions

User: The User is any person who uses the Site or any of the Services offered on the Site.
User Content: The term “User Content” refers to the data transmitted by the User on the different sections of the Site.
Member: The term “Member” refers to a User identified on the Site.
ID: The term “ID” denotes the information required to identify a User on the Site to access Member-only areas.
Password: The “Password” is confidential information which the User must keep secret and which allows him to him to prove his identity when used together with his ID.

Accessing the Service

The Service is available free of charge to any User with access to the Internet. All costs related to accessing the Service, whether for hardware, software or Internet access, are exclusively at the User’s expense. He alone is responsible for the proper functioning of his computer equipment and Internet access.

Some sections of the Site are for Members only after signing in with their ID and Password.

The Service reserves the right to refuse access to the Service, independently and without prior notice, to any User who does not comply with these Terms and Conditions of Use.

The Service deploys all reasonable means at its disposal to ensure quality access to the Service, but is under no obligation to do so.

Moreover, the Service cannot be held responsible for any malfunction in the network or servers or any other event beyond reasonable control which prevents or affects access to the Service.
The Service reserves the right to interrupt, suspend or change without notice access to all or part of the Service, to maintain it, or for any other reason, with the interruption providing no grounds for any obligation or compensation.

Intellectual property

The Service, specifically the content thereof, is protected by French law. The Service is the exclusive owner of all intellectual property rights on the Site and its content (texts, photographs, illustrations, images and logos etc.).

The content reproduced on the Site is subject to copyright and the reproduction or distribution thereof, without the express written permission of the Service, constitutes forgery punishable by criminal penalties.

Joubert Productions is a registered name of the Service. Any unauthorised reproduction of these trademarks, logos and distinctive signs constitutes forgery punishable by criminal penalties. The offender is liable to civil and criminal penalties, including the penalties provided for in Articles L. 335.2 and L. 343.1 of the Intellectual Property Code.

The User alone is responsible for the User Content that he uploads via the Service, as well as texts and/or opinions that he formulates. The User expressly and freely transfers to the Service all related intellectual property rights and in particular the right of reproduction, representation and adaptation, for the legal term of copyright protection. He undertakes in particular to ensure that this data is not likely to affect the legitimate interests of third parties whatsoever. As such, he guarantees the Service against any claims, based directly or indirectly on these remarks and/or data, which are likely to be brought by anyone against the Service. In particular, he undertakes to pay the sums, whatever they may be, resulting from a third-party claim against the Service, including legal fees and court costs.

The Service reserves the right to delete all or part of the User Content, at any time and for any reason, without notice or prior justification. The User cannot make any claim in this respect.

Personal data & data processing

In accordance with Article 34 of the French Data Protection Act, the Service guarantees the User the right to oppose, access and rectify personal data about him.

The information collected on the contact forms is recorded in an electronic file created by Joubert Productions for the management of contact and Service requests, and is limited to what is strictly necessary in accordance with European regulations (GDPR). No form data is transmitted to third parties.

It is held for a maximum of one year and is intended for the Commercial or Technical Department only.

Cookies and collected data

Applicable law and place of jurisdiction

The rules of law applicable to content and data transmissions on and around the Site are governed by French law. In the event of a dispute where an amicable agreement cannot be reached, only the French courts under the jurisdiction of Clermont-Ferrand Court of Appeal are competent.
